VIDEO TRANSCRIPT: In order to win a slip and fall injury case, generally speaking, you have to prove that the business owner, the property owner, failed to maintain their property in a reasonably safe condition for the benefit of the person who fell, to whom they owe a legal duty. Or you have to prove that they failed to warn somebody about a known hazard or a condition that through reasonable inspection or maintenance they would’ve become aware of. And so when you slip and fall in a business, the claim is against the business for one of those two breaches of duty, so to speak which are: they failed to maintain their premises in a reasonably safe condition or they failed to warn you about a hazard that they should’ve taken care of. Those are the things that an injured person has to prove or establish when bringing a slip and fall case.
